Two laws protect Tennessee residents

The TCPA is the federal engine behind every robocall claim. Tennessee adds a state register with civil penalties enforced by the Public Utility Commission.

Federal law

The TCPA

The Telephone Consumer Protection Act, the nationwide law behind every claim.

  • Protects everyone in Tennessee, no matter the state rules.
  • Bars autodialed or prerecorded calls and texts to your cell without consent.
  • $500 to $1,500 per call, stacking with every violation.
  • You can sue personally, you don’t wait on the government.
Tennessee law

Tennessee telephone solicitation law, Tenn. Code Ann. § 65-4-401 et seq.

What Tennessee adds on top of the federal rules.

  • State register: § 65-4-405 directs the Public Utility Commission to keep a database of residential numbers, landline and cell, that object to solicitation calls and texts.
  • Penalties: up to $2,000 in civil penalties for each knowing violation, and each call or text to a listed number can count as a separate violation.
  • Solicitor registration: telemarketers must register with the Commission and pay an annual fee to obtain the register.
  • Texts included: the program was amended in 2023 to cover text message solicitations.

How the law works in Tennessee

The Telephone Consumer Protection Act, 47 U.S.C. § 227, is a federal law, so it protects a phone in Memphis exactly as it protects one in Nashville, Knoxville or Chattanooga. It bars autodialed and prerecorded calls and texts to cell phones without consent and bars telemarketing calls to numbers on the national Do Not Call Registry. Each illegal call or text carries $500 in statutory damages, and up to $1,500 when the violation was willful or knowing. The amounts stack per call, which is why a campaign that hits a 615 or 901 number several times a week can grow into a meaningful claim.

Tennessee is one of the states that still keeps its own list. Under Tenn. Code Ann. § 65-4-405, the Tennessee Public Utility Commission maintains a Do Not Call/Text Register of residential landline and cell numbers, and telemarketers who want to call Tennessee residents must register with the Commission and pay an annual fee to obtain it. Calling or texting a listed number without an exemption exposes the caller to a civil penalty of up to $2,000 per knowing violation, and the statute treats each call or text as its own violation. The Commission enforces the register through its Consumer Services Division. The Tennessee Attorney General’s Division of Consumer Affairs handles broader consumer complaints and mediation. The state penalties go to the state, not to you. Your money comes from the TCPA, and the state register violation is useful evidence that the caller ignored a clear signal to stop.

Federal TCPA suits from Tennessee are filed in one of three districts: the Eastern District (Knoxville, Chattanooga and Greeneville), the Middle District (Nashville) or the Western District (Memphis and Jackson). Cases are handled nationwide under the federal TCPA. Local counsel is associated where Tennessee rules require it. Max Morgan, Esq. is licensed in Pennsylvania and reviews call records at no charge; there is no attorney’s fee unless you recover. The federal TCPA limitations period is generally four years, but state claims can carry shorter deadlines, so talk to us before assuming there is time.

Getting illegal calls in Tennessee? Do this.

  1. Register on both lists.Add your number to the national Do Not Call Registry at donotcall.gov and to the Tennessee Do Not Call/Text Register on the Tennessee Public Utility Commission site at tn.gov/tpuc. Both are free for residential numbers, including cell phones used for personal calls.
  2. Keep the evidence.Do not delete calls, voicemails or texts. Screenshot your call log and write down the number, the company if you can tell, and what the recording said.
  3. Complain in Tennessee and nationally.File a Do Not Call complaint with the Public Utility Commission’s Consumer Services Division, file a consumer complaint with the Tennessee Attorney General’s Division of Consumer Affairs at tn.gov/attorneygeneral, and report the calls to the FTC at reportfraud.ftc.gov and the FCC at consumercomplaints.fcc.gov.
  4. Say stop, then get a free review.Tell the caller to stop if it is safe to do so. Calls that continue after that can be worth up to $1,500 each. Then find out whether your Tennessee calls qualify.

Why Tennessee residents reach out

Three patterns we see from Tennessee phones. If one sounds familiar, it is worth a free look.

“I registered with the Tennessee Public Utility Commission and the national registry, and a home warranty company still texts me every few days.”
Marketing texts to a registered cell number are covered by the TCPA just like calls. See how a spam text message lawsuit works.
“A Nashville medical billing company robocalls my cell about a patient I have never heard of.”
A wrong-number campaign means you never consented, which is the core of a TCPA claim. Read about wrong-number robocall claims.
“I told a Memphis lender to stop calling and it kept going for two months.”
Calls after a clear stop request can be treated as willful, which is where the $1,500 figure comes from. More on calls after you said stop.

Tennessee robocall FAQs

Does Tennessee have its own Do Not Call list?

Yes. Tenn. Code Ann. § 65-4-405 requires the Tennessee Public Utility Commission to keep a Do Not Call/Text Register of residential landline and cell numbers. Registration is free on the Commission’s site and, since 2023, the register also covers text messages. Register on the national Do Not Call Registry as well, because the federal TCPA claim is built on that list.

Which court would a Tennessee robocall case go to?

TCPA cases are federal, so they are usually filed in one of Tennessee’s three federal districts: the Eastern District in Knoxville, Chattanooga and Greeneville, the Middle District in Nashville, or the Western District in Memphis and Jackson. We pick the district after reviewing where you live and where the calls came in.

Do I need a Tennessee lawyer for a robocall case?

Not necessarily. The TCPA is a federal law, so the attorney bringing the claim does not have to be based in Tennessee. Cases are handled nationwide under the federal TCPA, and local counsel is associated where Tennessee rules require it. Your review is free and there is no attorney’s fee unless you recover.

Does Tennessee law add anything to the federal TCPA?

The state register adds enforcement weight. A telemarketer that calls or texts a number on the Tennessee register faces civil penalties of up to $2,000 per knowing violation, imposed by the Public Utility Commission. Those penalties go to the state, but the violation is strong evidence in a federal claim that the caller ignored your objection.

Does Tennessee set telemarketing calling hours?

Tenn. Code Ann. § 65-4-405 does not set its own hours. Federal telemarketing rules bar sales calls before 8 a.m. or after 9 p.m. local time, and that rule applies in Tennessee. An autodialed or prerecorded call to your cell without consent is a TCPA violation at any hour.
