- Bars autodialed or prerecorded calls and texts to your cell without consent.
- $500–$1,500 per call, stacking with every violation.
- You can sue personally — you don’t wait on the government.

How the law works in New Jersey
The federal Telephone Consumer Protection Act (TCPA) protects everyone in New Jersey. The TCPA is the national law that makes it illegal for companies to robocall, robotext, or auto-dial your cell phone, or to call any number on the Do Not Call list, without your written permission. When a company breaks that rule, the law lets you collect $500 per illegal call or text, and up to $1,500 per call if the violation was willful. Those amounts stack: every separate call or text is its own violation, so a few weeks of robocalls can add up fast.
New Jersey layers strong protection on top. Under New Jersey’s Do Not Call law (N.J.S.A. 56:8-119 et seq.), telemarketers may not make unsolicited sales calls between 9 p.m. and 8 a.m., so calls are only allowed from 8 a.m. to 9 p.m. New Jersey does not run a separate state registry. Anyone who signs up for the national Do Not Call Registry is automatically placed on the state’s list and covered, including home and cell numbers. The Division of Consumer Affairs enforces the law with penalties up to $10,000 for a first offense and up to $20,000 for each later offense, on top of your own private claim.

New Jersey robocall FAQs
Can I sue for robocalls in New Jersey?
Yes. The federal TCPA lets New Jersey residents sue for $500 to $1,500 per illegal robocall, robotext, or auto-dialed call to a cell phone, and per call to any number on the Do Not Call Registry. New Jersey’s Do Not Call law adds further protections enforced by the Division of Consumer Affairs. Save your call logs and any voicemails. They are your evidence.
Does New Jersey run its own Do Not Call list?
Not a separate one. New Jersey’s Do Not Call law (N.J.S.A. 56:8-119 et seq.) ties into the national Do Not Call Registry. Anyone who signs up for the national list is automatically placed on the state’s list and covered, for both home and cell numbers. The Division of Consumer Affairs can pursue violators with steep penalties, and you can also bring your own claim under the federal TCPA.
What are New Jersey’s calling hours?
Telemarketers may only call New Jersey consumers between 8 a.m. and 9 p.m. Unsolicited sales calls between 9 p.m. and 8 a.m. are prohibited. A call placed outside those hours violates state law, and that same call may also break the federal TCPA, which can mean money in your pocket.
Do I need a New Jersey lawyer for a robocall case?
Not specifically. The TCPA is a federal law, so you do not need an attorney based in New Jersey. Max Morgan represents New Jersey residents and brings in local counsel wherever a case requires it. Your review is free, and there is no fee unless you recover.
